These Terms and Conditions (“Terms”) explain the rules for using Orbitacare, operated by Orbitasoft Limited (“Orbitacare,” “we,” “our,” or “us”).

These Terms apply to the Orbitacare website at www.orbitacare.com and the Orbitacare mobile applications for Android and iOS, including all related services, features, content, and communications.

By accessing or using Orbitacare, you agree to these Terms. If you do not agree, please do not use our website, app, or services.

1. Our Services

Orbitacare provides digital healthcare-related services, including doctor appointment booking, doctor search by specialty, hospital, location, and symptoms, doctor profiles, booking management, family member profiles, health record uploads, health tips, medicine purchase support, diagnostic test booking, home care, emergency healthcare, emergency ambulance support, AI care/chatbot, medicine reminders, reminder settings, push notifications, and related services.

Orbitacare is a technology platform that helps users connect with doctors and healthcare service providers. Orbitacare does not itself provide medical diagnosis, medical treatment, prescriptions, emergency medical care, ambulance operation, pharmacy services, diagnostic services, or home care services unless specifically stated.

2. Eligibility and Use by Minors

You may use Orbitacare if you are legally able to agree to these Terms or if you use Orbitacare with the consent and supervision of a parent or legal guardian.

Users under 18 years of age should use Orbitacare with parent or guardian consent and supervision. Parents or guardians may add children or minors as family members and may manage healthcare-related services for them.

If you are a parent or guardian and believe a minor has used Orbitacare without proper consent or supervision, please contact us at support@orbitacare.com.

3. Account Registration

Some services require you to create an account. When creating or updating an account, you agree to provide accurate, current, and complete information, including your name, email address, mobile number, date of birth, gender, address, and other required details.

You are responsible for keeping your login credentials confidential. You are also responsible for all activity that occurs under your account. If you believe your account has been accessed without permission, please contact us immediately.

4. Family Member Profiles

Orbitacare allows users to add and manage family member profiles. You agree that you have permission or legal authority to provide information about any family member you add to your account.

You are responsible for ensuring that family member information, including health records, appointment information, and contact details, is accurate and submitted with appropriate consent.

5. Doctor Appointments and Healthcare Providers

Doctors available through Orbitacare are independent healthcare providers. They are not employees of Orbitacare. Doctors are responsible for the medical advice, diagnosis, treatment, prescriptions, notes, reports, follow-up instructions, and services they provide.

Orbitacare may help users search for doctors, view doctor profiles, book appointments, rebook appointments, cancel bookings, and manage booking history. However, Orbitacare does not guarantee that a doctor will be available at a requested time or that an appointment will result in any specific medical outcome.

Doctor profiles, qualifications, specialties, availability, fees, locations, and other information may be provided by doctors, healthcare organizations, or third-party sources. We try to keep this information accurate, but we do not guarantee that all information is always complete, updated, or error-free.

6. Medical Disclaimer

Orbitacare is not a substitute for professional medical advice, diagnosis, treatment, or emergency care. Information provided through Orbitacare, including health tips, educational content, AI chatbot responses, reminders, and service information, is for general informational and support purposes only.

Always seek advice from a qualified doctor or healthcare professional for medical concerns. Do not ignore professional medical advice or delay seeking care because of information you received through Orbitacare.

If you have a medical emergency, contact local emergency services or go to the nearest emergency medical facility immediately.

7. AI Care/Chatbot

Orbitacare may provide AI care or chatbot features. The AI chatbot may use third-party artificial intelligence service providers to process messages and generate responses.

AI chatbot responses may be incomplete, inaccurate, delayed, or unsuitable for your specific situation. The AI chatbot does not replace a doctor, pharmacist, emergency responder, or other qualified healthcare provider.

Do not submit emergency information or highly sensitive information to the AI chatbot. For urgent or serious medical conditions, contact a qualified healthcare professional or emergency service immediately.

8. Health Records and User Content

Orbitacare may allow you to upload, store, view, and share health records, including lab test reports, vaccination records, prescriptions, diagnostic reports, medical history, doctor notes, consultation records, home care records, ambulance or emergency records, medicine reminder data, and other related information.

You are responsible for the accuracy, legality, and appropriateness of the information and documents you upload. You agree not to upload false, misleading, harmful, illegal, unauthorized, or infringing content.

You may choose to share health records with selected doctors. Selected doctors may access the records you share or records needed for your appointment or consultation.

By uploading content to Orbitacare, you give us permission to store, process, display, and transmit that content as needed to provide our services, operate the platform, comply with legal obligations, and support your requested healthcare-related services.

9. Hospitals, Pharmacies, Diagnostic Centers, Ambulance, and Home Care Providers

Orbitacare may help connect users with hospitals, pharmacies, diagnostic centers, ambulance providers, home care providers, and other healthcare-related service providers.

We may share limited contact information with these providers when needed to arrange or provide the service requested by you.

These third-party providers are responsible for their own services, professional practices, medical practices, privacy practices, pricing, availability, quality, timing, and outcomes. Orbitacare is not responsible for acts, omissions, errors, delays, negligence, or service quality of independent third-party providers.

10. Medicine Purchase Support

Orbitacare may provide medicine purchase support or help connect users with medicine providers. Medicine availability, pricing, delivery, suitability, and use may depend on third-party pharmacies or providers.

You should only use medicine as directed by a qualified healthcare professional. Orbitacare is not responsible for misuse of medicine, incorrect self-medication, or failure to follow professional medical advice.

11. Diagnostic Test Booking

Orbitacare may help users book diagnostic tests through third-party diagnostic centers or service providers. Test availability, pricing, scheduling, sample collection, report delivery, report accuracy, and service quality are the responsibility of the relevant diagnostic provider.

12. Home Care, Emergency Healthcare, and Ambulance Services

Orbitacare may help users request home care, emergency healthcare support, and emergency ambulance services through third-party providers.

Emergency, ambulance, and home care services may depend on location, availability, provider capacity, traffic, weather, technical issues, and other factors outside our control. Orbitacare does not guarantee response time, availability, medical outcome, or uninterrupted emergency service.

In a life-threatening emergency, you should immediately contact local emergency services or go to the nearest emergency medical facility.

13. Medicine Reminders and Notifications

Orbitacare may provide medicine reminders, appointment reminders, booking confirmations, cancellation messages, rebooking messages, health tips, push notifications, SMS, emails, and WhatsApp messages.

Reminders and notifications are provided for convenience only. They may be delayed, inaccurate, blocked, or not delivered due to device settings, network issues, service outages, third-party provider issues, or other reasons. You remain responsible for following medical instructions, taking medicines correctly, attending appointments, and managing your health.

14. Payments

Orbitacare does not currently process payments through the website or mobile app. Doctor fees or service fees may be displayed for information purposes. Any payment, billing, refund, or fee arrangement may be handled outside Orbitacare or directly with the relevant doctor or service provider.

If Orbitacare introduces in-app or online payments in the future, we may update these Terms and related policies.

15. Marketing, Ads, and Third-Party Tools

Orbitacare may send service messages, health tips, promotional offers, and marketing communications through push notifications, SMS, email, phone, or WhatsApp.

Orbitacare may also use analytics, cookies, tracking technologies, advertising tools, and third-party SDKs, including tools such as Google Analytics, Firebase Analytics, Firebase Cloud Messaging, Mailchimp, local SMS providers, Google AdMob, Google Ads, Meta Ads, Facebook Pixel, Google Maps, Mapbox, and AI service providers.

Your use of third-party services may also be subject to those third parties’ own terms and privacy policies.

16. Acceptable Use

You agree not to:

  • Use Orbitacare for any unlawful, harmful, fraudulent, abusive, or misleading purpose
  • Create an account using false or unauthorized information
  • Upload false, misleading, offensive, harmful, illegal, or unauthorized content
  • Impersonate another person or misrepresent your identity or relationship
  • Access or attempt to access another user’s account or information without permission
  • Interfere with the operation, security, or availability of Orbitacare
  • Use bots, scraping, automated tools, or unauthorized methods to access Orbitacare
  • Copy, modify, reverse engineer, or misuse any part of the app, website, software, or content
  • Use Orbitacare to harass, threaten, defame, or harm another person
  • Violate any applicable law, regulation, or third-party right

17. Suspension or Termination

We may suspend, restrict, or terminate your access to Orbitacare if we believe you have violated these Terms, provided false information, misused our services, created risk for other users, violated applicable law, or harmed the security or reputation of Orbitacare.

You may stop using Orbitacare at any time. You may also use the Delete Account option or contact us at support@orbitacare.com for account-related requests.

18. Account Deletion

When you delete your account, your account, family members, and related records may be soft deleted, deactivated, or hidden from normal use. Deleted accounts and related records may still be retained in backup, audit, legal, medical, security, or compliance systems as required.

We aim to process account deletion and privacy-related requests within the next 7 working days, subject to verification, technical limitations, legal requirements, and operational needs.

19. Intellectual Property

Orbitacare, including its name, logo, design, interface, software, features, content, graphics, icons, text, and other materials, is owned by or licensed to Orbitasoft Limited, unless otherwise stated.

You may use Orbitacare only for personal, lawful, and permitted purposes. You may not copy, reproduce, distribute, sell, rent, modify, or create derivative works from Orbitacare materials without our written permission.

20. Third-Party Content and Links

Orbitacare may include third-party content, links, tools, maps, ads, healthcare provider information, or external services. We are not responsible for third-party websites, apps, content, services, availability, accuracy, policies, or practices.

Your interactions with third parties are between you and the relevant third party.

21. Availability and Changes to Services

We try to keep Orbitacare available and useful, but we do not guarantee that the website, app, or services will always be available, uninterrupted, secure, accurate, or error-free.

We may update, modify, suspend, remove, or discontinue any part of Orbitacare at any time, with or without notice.

22. No Warranty

Orbitacare is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we do not make warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, or medical suitability.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Orbitasoft Limited, Orbitacare, and their directors, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of data, loss of profits, service interruption, medical outcome, delay, third-party service issue, or unauthorized access.

Orbitacare is not responsible for the acts, omissions, advice, diagnosis, treatment, prescriptions, delays, errors, negligence, or services of independent doctors, hospitals, pharmacies, diagnostic centers, ambulance providers, home care providers, or other third-party providers.

24. Indemnity

You agree to defend, indemnify, and hold harmless Orbitasoft Limited, Orbitacare, and their directors, employees, contractors, partners, and service providers from any claims, losses, damages, liabilities, costs, or expenses arising from your use of Orbitacare, your violation of these Terms, your uploaded content, your misuse of services, or your violation of any law or third-party right.

25. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using Orbitacare, you also agree to our Privacy Policy.

26. Governing Law

These Terms are governed by the laws of Bangladesh, without regard to conflict of law principles.

27. Disputes

If you have a concern or dispute, please contact us first at support@orbitacare.com so we can try to resolve it informally.

Any dispute arising from or related to these Terms, Orbitacare, or our services shall be subject to the competent courts of Bangladesh, unless applicable law requires otherwise.

28. Changes to These Terms

We may update these Terms from time to time. If we make important changes, we may notify you through the website, app, email, SMS, push notification, or other suitable methods. The updated Terms will be effective when posted or otherwise notified.

Your continued use of Orbitacare after the updated Terms become effective means you accept the updated Terms.

১. আমাদের সেবা

Orbitacare ডিজিটাল স্বাস্থ্যসেবা-সম্পর্কিত সেবা প্রদান করে, যেমন ডাক্তার অ্যাপয়েন্টমেন্ট বুকিং, স্পেশালিটি, হাসপাতাল, লোকেশন ও উপসর্গ অনুযায়ী ডাক্তার খোঁজা, ডাক্তার প্রোফাইল, বুকিং ম্যানেজমেন্ট, পরিবারের সদস্যের প্রোফাইল, স্বাস্থ্য রেকর্ড আপলোড, স্বাস্থ্য টিপস, ওষুধ কেনার সহায়তা, ডায়াগনস্টিক টেস্ট বুকিং, হোম কেয়ার, জরুরি স্বাস্থ্যসেবা, জরুরি অ্যাম্বুলেন্স সহায়তা, AI কেয়ার/চ্যাটবট, ওষুধ রিমাইন্ডার, রিমাইন্ডার সেটিংস, পুশ নোটিফিকেশন এবং সংশ্লিষ্ট সেবা।

Orbitacare একটি প্রযুক্তি প্ল্যাটফর্ম, যা ব্যবহারকারীদের ডাক্তার এবং স্বাস্থ্যসেবা প্রদানকারীদের সাথে সংযুক্ত করতে সহায়তা করে। নির্দিষ্টভাবে বলা না থাকলে Orbitacare নিজে চিকিৎসা নির্ণয়, চিকিৎসা, প্রেসক্রিপশন, জরুরি চিকিৎসা, অ্যাম্বুলেন্স পরিচালনা, ফার্মেসি সেবা, ডায়াগনস্টিক সেবা বা হোম কেয়ার সেবা প্রদান করে না।

২. যোগ্যতা এবং অপ্রাপ্তবয়স্কদের ব্যবহার

আপনি Orbitacare ব্যবহার করতে পারেন যদি আপনি আইনগতভাবে এই শর্তাবলিতে সম্মত হতে সক্ষম হন অথবা পিতা-মাতা বা আইনগত অভিভাবকের সম্মতি ও তত্ত্বাবধানে ব্যবহার করেন।

১৮ বছরের কম বয়সী ব্যবহারকারীদের পিতা-মাতা বা অভিভাবকের সম্মতি ও তত্ত্বাবধানে Orbitacare ব্যবহার করা উচিত। পিতা-মাতা বা অভিভাবক শিশু বা অপ্রাপ্তবয়স্কদের পরিবারের সদস্য হিসেবে যোগ করতে এবং তাদের স্বাস্থ্যসেবা-সম্পর্কিত সেবা পরিচালনা করতে পারেন।

আপনি যদি পিতা-মাতা বা অভিভাবক হন এবং মনে করেন কোনো অপ্রাপ্তবয়স্ক যথাযথ সম্মতি বা তত্ত্বাবধান ছাড়া Orbitacare ব্যবহার করেছে, তাহলে support@orbitacare.com-এ আমাদের সাথে যোগাযোগ করুন।

৩. অ্যাকাউন্ট নিবন্ধন

কিছু সেবা ব্যবহার করতে অ্যাকাউন্ট তৈরি করতে হতে পারে। অ্যাকাউন্ট তৈরি বা আপডেট করার সময় আপনি সঠিক, বর্তমান এবং সম্পূর্ণ তথ্য প্রদান করতে সম্মত হন, যেমন নাম, ইমেইল, মোবাইল নম্বর, জন্ম তারিখ, লিঙ্গ, ঠিকানা এবং অন্যান্য প্রয়োজনীয় তথ্য।

আপনার লগইন তথ্য গোপন রাখা আপনার দায়িত্ব। আপনার অ্যাকাউন্টের অধীনে হওয়া সকল কার্যক্রমের জন্যও আপনি দায়ী। আপনি যদি মনে করেন আপনার অ্যাকাউন্ট অনুমতি ছাড়া ব্যবহার করা হয়েছে, তাহলে দ্রুত আমাদের জানান।

৪. পরিবারের সদস্যের প্রোফাইল

Orbitacare ব্যবহারকারীদের পরিবারের সদস্যের প্রোফাইল যোগ ও পরিচালনা করতে দেয়। আপনি সম্মত হন যে আপনি যেকোনো পরিবারের সদস্যের তথ্য প্রদান করার অনুমতি বা আইনগত অধিকার রাখেন।

পরিবারের সদস্যের তথ্য, স্বাস্থ্য রেকর্ড, অ্যাপয়েন্টমেন্ট তথ্য এবং যোগাযোগের তথ্য যথাযথ সম্মতিসহ সঠিকভাবে প্রদান করা আপনার দায়িত্ব।

৫. ডাক্তার অ্যাপয়েন্টমেন্ট এবং স্বাস্থ্যসেবা প্রদানকারী

Orbitacare-এ উপলব্ধ ডাক্তাররা স্বাধীন স্বাস্থ্যসেবা প্রদানকারী। তারা Orbitacare-এর কর্মচারী নন। ডাক্তাররা তাদের প্রদত্ত চিকিৎসা পরামর্শ, রোগ নির্ণয়, চিকিৎসা, প্রেসক্রিপশন, নোট, রিপোর্ট, ফলো-আপ নির্দেশনা এবং সেবার জন্য দায়ী।

৬. চিকিৎসা-সংক্রান্ত দায় অস্বীকার

Orbitacare পেশাদার চিকিৎসা পরামর্শ, রোগ নির্ণয়, চিকিৎসা বা জরুরি চিকিৎসার বিকল্প নয়। Orbitacare-এর মাধ্যমে দেওয়া তথ্য, যেমন স্বাস্থ্য টিপস, শিক্ষামূলক কনটেন্ট, AI চ্যাটবটের উত্তর, রিমাইন্ডার এবং সেবা তথ্য, শুধুমাত্র সাধারণ তথ্য ও সহায়তার জন্য।

চিকিৎসা-সংক্রান্ত কোনো বিষয়ে সবসময় যোগ্য ডাক্তার বা স্বাস্থ্যসেবা পেশাদারের পরামর্শ নিন। Orbitacare থেকে পাওয়া তথ্যের কারণে পেশাদার চিকিৎসা পরামর্শ উপেক্ষা করবেন না বা চিকিৎসা নিতে দেরি করবেন না।

জরুরি চিকিৎসা পরিস্থিতিতে স্থানীয় জরুরি সেবায় যোগাযোগ করুন বা নিকটস্থ জরুরি চিকিৎসা কেন্দ্রে যান।

৭. AI কেয়ার/চ্যাটবট

Orbitacare AI কেয়ার বা চ্যাটবট ফিচার প্রদান করতে পারে। AI চ্যাটবট মেসেজ প্রক্রিয়া এবং উত্তর তৈরির জন্য তৃতীয় পক্ষের কৃত্রিম বুদ্ধিমত্তা সেবা প্রদানকারী ব্যবহার করতে পারে।

AI চ্যাটবটের উত্তর অসম্পূর্ণ, ভুল, বিলম্বিত বা আপনার নির্দিষ্ট পরিস্থিতির জন্য অনুপযুক্ত হতে পারে। AI চ্যাটবট কোনো ডাক্তার, ফার্মাসিস্ট, জরুরি সেবাদাতা বা যোগ্য স্বাস্থ্যসেবা প্রদানকারীর বিকল্প নয়।

AI চ্যাটবটে জরুরি তথ্য বা অত্যন্ত সংবেদনশীল তথ্য জমা দেবেন না। জরুরি বা গুরুতর চিকিৎসা পরিস্থিতিতে দ্রুত যোগ্য স্বাস্থ্যসেবা পেশাদার বা জরুরি সেবার সাথে যোগাযোগ করুন।

৮. স্বাস্থ্য রেকর্ড এবং ব্যবহারকারীর কনটেন্ট

Orbitacare আপনাকে ল্যাব টেস্ট রিপোর্ট, টিকা রেকর্ড, প্রেসক্রিপশন, ডায়াগনস্টিক রিপোর্ট, মেডিকেল ইতিহাস, ডাক্তারের নোট, কনসালটেশন রেকর্ড, হোম কেয়ার রেকর্ড, অ্যাম্বুলেন্স বা জরুরি সেবার রেকর্ড, ওষুধ রিমাইন্ডার ডেটা এবং অন্যান্য সংশ্লিষ্ট তথ্য আপলোড, সংরক্ষণ, দেখা এবং শেয়ার করার সুযোগ দিতে পারে।

আপনার আপলোড করা তথ্য ও ডকুমেন্টের সঠিকতা, বৈধতা এবং উপযুক্ততার জন্য আপনি দায়ী। আপনি মিথ্যা, বিভ্রান্তিকর, ক্ষতিকর, অবৈধ, অননুমোদিত বা অধিকার লঙ্ঘনকারী কনটেন্ট আপলোড না করতে সম্মত হন।

আপনি নির্বাচিত ডাক্তারদের সাথে স্বাস্থ্য রেকর্ড শেয়ার করতে পারেন। নির্বাচিত ডাক্তার আপনার শেয়ার করা বা অ্যাপয়েন্টমেন্ট/কনসালটেশনের জন্য প্রয়োজনীয় রেকর্ড দেখতেপারেন।

Orbitacare-এ কনটেন্ট আপলোড করার মাধ্যমে আপনি আমাদের আপনার সেবা প্রদান, প্ল্যাটফর্ম পরিচালনা, আইনি বাধ্যবাধকতা পূরণ এবং আপনার অনুরোধ করা স্বাস্থ্যসেবা-সম্পর্কিত সেবা সমর্থনের জন্য সেই কনটেন্ট সংরক্ষণ, প্রক্রিয়া, প্রদর্শন এবং প্রেরণ করার অনুমতি দেন।

৯. হাসপাতাল, ফার্মেসি, ডায়াগনস্টিক সেন্টার, অ্যাম্বুলেন্স ও হোম কেয়ার প্রদানকারী

Orbitacare ব্যবহারকারীদের হাসপাতাল, ফার্মেসি, ডায়াগনস্টিক সেন্টার, অ্যাম্বুলেন্স প্রদানকারী, হোম কেয়ার প্রদানকারী এবং অন্যান্য স্বাস্থ্যসেবা-সম্পর্কিত সেবা প্রদানকারীর সাথে সংযুক্ত করতে সহায়তা করতে পারে।

আপনার অনুরোধ করা সেবা ব্যবস্থা বা প্রদানের জন্য প্রয়োজন হলে আমরা এসব প্রদানকারীর সাথে সীমিত যোগাযোগের তথ্য শেয়ার করতে পারি।

এসব তৃতীয় পক্ষ তাদের নিজস্ব সেবা, পেশাগত কার্যক্রম, চিকিৎসা কার্যক্রম, গোপনীয়তা নীতি, মূল্য, প্রাপ্যতা, মান, সময় এবং ফলাফলের জন্য দায়ী। স্বাধীন তৃতীয় পক্ষের কাজ, ত্রুটি, বিলম্ব, অবহেলা বা সেবার মানের জন্য Orbitacare দায়ী নয়।

১০. ওষুধ কেনার সহায়তা

Orbitacare ওষুধ কেনার সহায়তা বা ব্যবহারকারীদের ওষুধ প্রদানকারীর সাথে সংযুক্ত করতে পারে। ওষুধের প্রাপ্যতা, মূল্য, ডেলিভারি, উপযুক্ততা এবং ব্যবহার তৃতীয় পক্ষের ফার্মেসি বা প্রদানকারীর ওপর নির্ভর করতে পারে।

শুধুমাত্র যোগ্য স্বাস্থ্যসেবা পেশাদারের নির্দেশনা অনুযায়ী ওষুধ ব্যবহার করুন। ভুলভাবে ওষুধ ব্যবহার, নিজে নিজে চিকিৎসা করা বা পেশাদার চিকিৎসা পরামর্শ না মানার জন্য Orbitacare দায়ী নয়।

১১. ডায়াগনস্টিক টেস্ট বুকিং

Orbitacare ব্যবহারকারীদের তৃতীয় পক্ষের ডায়াগনস্টিক সেন্টার বা সেবা প্রদানকারীর মাধ্যমে ডায়াগনস্টিক টেস্ট বুক করতে সহায়তা করতে পারে। টেস্টের প্রাপ্যতা, মূল্য, সময়সূচি, স্যাম্পল সংগ্রহ, রিপোর্ট ডেলিভারি, রিপোর্টের সঠিকতা এবং সেবার মান সংশ্লিষ্ট ডায়াগনস্টিক প্রদানকারীর দায়িত্ব।

১২. হোম কেয়ার, জরুরি স্বাস্থ্যসেবা এবং অ্যাম্বুলেন্স সেবা

Orbitacare ব্যবহারকারীদের তৃতীয় পক্ষের প্রদানকারীর মাধ্যমে হোম কেয়ার, জরুরি স্বাস্থ্যসেবা সহায়তা এবং জরুরি অ্যাম্বুলেন্স সেবা অনুরোধ করতে সহায়তা করতে পারে।

জরুরি, অ্যাম্বুলেন্স এবং হোম কেয়ার সেবা লোকেশন, প্রাপ্যতা, প্রদানকারীর সক্ষমতা, ট্রাফিক, আবহাওয়া, প্রযুক্তিগত সমস্যা এবং আমাদের নিয়ন্ত্রণের বাইরের অন্যান্য বিষয়ের ওপর নির্ভর করতে পারে। Orbitacare সাড়া দেওয়ার সময়, প্রাপ্যতা, চিকিৎসা ফলাফল বা নিরবচ্ছিন্ন জরুরি সেবার নিশ্চয়তা দেয় না।

জীবন-ঝুঁকিপূর্ণ জরুরি অবস্থায় দ্রুত স্থানীয় জরুরি সেবায় যোগাযোগ করুন বা নিকটস্থ জরুরি চিকিৎসা কেন্দ্রে যান।

১৩. ওষুধ রিমাইন্ডার এবং নোটিফিকেশন

Orbitacare ওষুধ রিমাইন্ডার, অ্যাপয়েন্টমেন্ট রিমাইন্ডার, বুকিং কনফার্মেশন, বাতিলকরণ মেসেজ, রিবুকিং মেসেজ, স্বাস্থ্য টিপস, পুশ নোটিফিকেশন, SMS, ইমেইল এবং WhatsApp মেসেজ প্রদান করতে পারে।

রিমাইন্ডার ও নোটিফিকেশন শুধুমাত্র সুবিধার জন্য। ডিভাইস সেটিংস, নেটওয়ার্ক সমস্যা, সার্ভিস আউটেজ, তৃতীয় পক্ষের সমস্যা বা অন্যান্য কারণে এগুলো বিলম্বিত, ভুল, ব্লক বা ডেলিভার না-ও হতে পারে। চিকিৎসা নির্দেশনা মেনে চলা, ওষুধ সঠিকভাবে গ্রহণ করা, অ্যাপয়েন্টমেন্টে উপস্থিত থাকা এবং নিজের স্বাস্থ্য ম্যানেজ করার দায়িত্ব আপনার।

১৪. পেমেন্ট

Orbitacare বর্তমানে ওয়েবসাইট বা মোবাইল অ্যাপের মাধ্যমে পেমেন্ট প্রক্রিয়া করে না। ডাক্তার ফি বা সেবা ফি তথ্যের জন্য দেখানো হতে পারে। যেকোনো পেমেন্ট, বিলিং, রিফান্ড বা ফি-সংক্রান্ত ব্যবস্থা Orbitacare-এর বাইরে বা সংশ্লিষ্ট ডাক্তার/সেবা প্রদানকারীর সাথে সরাসরি হতে পারে।

ভবিষ্যতে Orbitacare ইন-অ্যাপ বা অনলাইন পেমেন্ট চালু করলে আমরা এই শর্তাবলি এবং সংশ্লিষ্ট নীতিমালা আপডেট করতে পারি।

১৫. মার্কেটিং, বিজ্ঞাপন এবং তৃতীয় পক্ষের টুল

Orbitacare পুশ নোটিফিকেশন, SMS, ইমেইল, ফোন বা WhatsApp-এর মাধ্যমে সেবা বার্তা, স্বাস্থ্য টিপস, প্রচারমূলক অফার এবং মার্কেটিং যোগাযোগ পাঠাতে পারে।

Orbitacare অ্যানালিটিক্স, কুকি, ট্র্যাকিং প্রযুক্তি, বিজ্ঞাপন টুল এবং তৃতীয় পক্ষের SDK ব্যবহার করতে পারে, যেমন Google Analytics, Firebase Analytics, Firebase Cloud Messaging, Mailchimp, লোকাল SMS প্রদানকারী, Google AdMob, Google Ads, Meta Ads, Facebook Pixel, Google Maps, Mapbox এবং AI সেবা প্রদানকারী।

তৃতীয় পক্ষের সেবা ব্যবহারের ক্ষেত্রে সেই তৃতীয় পক্ষের নিজস্ব শর্তাবলি ও গোপনীয়তা নীতিও প্রযোজ্য হতে পারে।

১৬. গ্রহণযোগ্য ব্যবহার

আপনি সম্মত হন যে আপনি করবেন না:

  • কোনো অবৈধ, ক্ষতিকর, প্রতারণামূলক, অপব্যবহারমূলক বা বিভ্রান্তিকর উদ্দেশ্যে Orbitacare ব্যবহার
  • মিথ্যা বা অননুমোদিত তথ্য দিয়ে অ্যাকাউন্ট তৈরি
  • মিথ্যা, বিভ্রান্তিকর, আপত্তিকর, ক্ষতিকর, অবৈধ বা অননুমোদিত কনটেন্ট আপলোড
  • অন্য ব্যক্তির পরিচয় ধারণ বা নিজের পরিচয়/সম্পর্ক ভুলভাবে উপস্থাপন
  • অনুমতি ছাড়া অন্য ব্যবহারকারীর অ্যাকাউন্ট বা তথ্য অ্যাক্সেস করার চেষ্টা
  • Orbitacare-এর কার্যক্রম, নিরাপত্তা বা প্রাপ্যতায় হস্তক্ষেপ
  • বট, স্ক্র্যাপিং, অটোমেটেড টুল বা অননুমোদিত পদ্ধতিতে Orbitacare অ্যাক্সেস
  • অ্যাপ, ওয়েবসাইট, সফটওয়্যার বা কনটেন্ট কপি, পরিবর্তন, রিভার্স ইঞ্জিনিয়ার বা অপব্যবহার
  • কাউকে হয়রানি, হুমকি, মানহানি বা ক্ষতি করার জন্য Orbitacare ব্যবহার
  • প্রযোজ্য আইন, বিধি বা তৃতীয় পক্ষের অধিকার লঙ্ঘন

১৭. স্থগিত বা বন্ধ করা

আমরা আপনার Orbitacare ব্যবহার স্থগিত, সীমিত বা বন্ধ করতে পারি যদি আমরা মনে করি আপনি এই শর্তাবলি লঙ্ঘন করেছেন, মিথ্যা তথ্য দিয়েছেন, সেবা অপব্যবহার করেছেন, অন্য ব্যবহারকারীর জন্য ঝুঁকি তৈরি করেছেন, আইন লঙ্ঘন করেছেন বা Orbitacare-এর নিরাপত্তা বা সুনাম ক্ষতিগ্রস্ত করেছেন।

আপনি যেকোনো সময় Orbitacare ব্যবহার বন্ধ করতে পারেন। অ্যাকাউন্ট-সংক্রান্ত অনুরোধের জন্য Delete Account অপশন ব্যবহার করতে পারেন বা support@orbitacare.com-এ যোগাযোগ করতে পারেন।

১৮. অ্যাকাউন্ট ডিলিট

আপনি অ্যাকাউন্ট ডিলিট করলে আপনার অ্যাকাউন্ট, পরিবারের সদস্য এবং সংশ্লিষ্ট রেকর্ড সফট ডিলিট, নিষ্ক্রিয় বা সাধারণ ব্যবহার থেকে লুকানো হতে পারে। ডিলিট করা অ্যাকাউন্ট ও সংশ্লিষ্ট রেকর্ড প্রয়োজন অনুযায়ী ব্যাকআপ, অডিট, আইনি, চিকিৎসা, নিরাপত্তা বা কমপ্লায়েন্স সিস্টেমে সংরক্ষিত থাকতে পারে।

যাচাই, প্রযুক্তিগত সীমাবদ্ধতা, আইনি প্রয়োজনীয়তা এবং অপারেশনাল প্রয়োজনের ভিত্তিতে আমরা সাধারণত পরবর্তী ৭ কার্যদিবসের মধ্যে অ্যাকাউন্ট ডিলিট এবং গোপনীয়তা-সংক্রান্ত অনুরোধ প্রক্রিয়া করার চেষ্টা করি।

১৯. মেধাস্বত্ব

Orbitacare-এর নাম, লোগো, ডিজাইন, ইন্টারফেস, সফটওয়্যার, ফিচার, কনটেন্ট, গ্রাফিক্স, আইকন, টেক্সট এবং অন্যান্য উপকরণ Orbitasoft Limited-এর মালিকানাধীন বা লাইসেন্সপ্রাপ্ত, যদি আলাদাভাবে বলা না থাকে।

আপনি Orbitacare শুধুমাত্র ব্যক্তিগত, বৈধ এবং অনুমোদিত উদ্দেশ্যে ব্যবহার করতে পারেন। আমাদের লিখিত অনুমতি ছাড়া Orbitacare উপকরণ কপি, পুনরুৎপাদন, বিতরণ, বিক্রি, ভাড়া, পরিবর্তন বা ডেরিভেটিভ কাজ তৈরি করতে পারবেন না।

২০. তৃতীয় পক্ষের কনটেন্ট ও লিংক

Orbitacare-এ তৃতীয় পক্ষের কনটেন্ট, লিংক, টুল, ম্যাপ, বিজ্ঞাপন, স্বাস্থ্যসেবা প্রদানকারীর তথ্য বা বাহ্যিক সেবা থাকতে পারে। তৃতীয় পক্ষের ওয়েবসাইট, অ্যাপ, কনটেন্ট, সেবা, প্রাপ্যতা, সঠিকতা, নীতি বা কার্যক্রমের জন্য আমরা দায়ী নই।

তৃতীয় পক্ষের সাথে আপনার যোগাযোগ আপনার এবং সংশ্লিষ্ট তৃতীয় পক্ষের মধ্যে।

২১. সেবার প্রাপ্যতা ও পরিবর্তন

আমরা Orbitacare চালু ও কার্যকর রাখার চেষ্টা করি, তবে ওয়েবসাইট, অ্যাপ বা সেবা সবসময় উপলব্ধ, নিরবচ্ছিন্ন, নিরাপদ, সঠিক বা ত্রুটিমুক্ত থাকবে—এমন নিশ্চয়তা দিই না।

আমরা যেকোনো সময় নোটিশসহ বা নোটিস ছাড়াই Orbitacare-এর কোনো অংশ আপডেট, পরিবর্তন, স্থগিত, অপসারণ বা বন্ধ করতে পারি।

২২. কোনো ওয়ারেন্টি নেই

Orbitacare “যেমন আছে” এবং “যেমন উপলব্ধ” ভিত্তিতে প্রদান করা হয়। প্রযোজ্য আইনে অনুমোদিত সর্বোচ্চ সীমা পর্যন্ত আমরা নির্ভুলতা, নির্ভরযোগ্যতা, প্রাপ্যতা, নির্দিষ্ট উদ্দেশ্যের উপযোগিতা, অধিকার লঙ্ঘন না করা বা চিকিৎসাগত উপযুক্ততা সম্পর্কে কোনো প্রকাশ্য, পরোক্ষ বা আইনগত ওয়ারেন্টি দিই না।

২৩. দায় সীমাবদ্ধতা

প্রযোজ্য আইনে অনুমোদিত সর্বোচ্চ সীমা পর্যন্ত Orbitasoft Limited, Orbitacare এবং তাদের পরিচালক, কর্মচারী, ঠিকাদার, পার্টনার ও সেবা প্রদানকারীরা কোনো পরোক্ষ, আকস্মিক, বিশেষ, ফলস্বরূপ, শাস্তিমূলক বা উদাহরণমূলক ক্ষতি, ডেটা ক্ষতি, লাভের ক্ষতি, সেবা বিঘ্ন, চিকিৎসা ফলাফল, বিলম্ব, তৃতীয় পক্ষের সেবা সমস্যা বা অননুমোদিত অ্যাক্সেসের জন্য দায়ী থাকবে না।

২৪. ক্ষতিপূরণ

আপনার Orbitacare ব্যবহার, এই শর্তাবলি লঙ্ঘন, আপলোড করা কনটেন্ট, সেবার অপব্যবহার, অথবা কোনো আইন বা তৃতীয় পক্ষের অধিকার লঙ্ঘন থেকে উদ্ভূত দাবি, ক্ষতি, দায়, খরচ বা ব্যয়ের ক্ষেত্রে আপনি Orbitasoft Limited, Orbitacare এবং তাদের পরিচালক, কর্মচারী, ঠিকাদার, পার্টনার ও সেবা প্রদানকারীদের রক্ষা, ক্ষতিপূরণ এবং দায়মুক্ত রাখতে সম্মত হন।

২৫. গোপনীয়তা

ব্যক্তিগত তথ্য সংগ্রহ ও ব্যবহার আমাদের গোপনীয়তা নীতিতে ব্যাখ্যা করা হয়েছে। Orbitacare ব্যবহার করার মাধ্যমে আপনি আমাদের গোপনীয়তা নীতিতেও সম্মত হন।

২৬. প্রযোজ্য আইন

এই শর্তাবলি বাংলাদেশের আইন দ্বারা নিয়ন্ত্রিত হবে, সংঘাতমূলক আইন নীতির তোয়াক্কা না করে।

২৭. বিরোধ

আপনার কোনো অভিযোগ বা বিরোধ থাকলে প্রথমে support@orbitacare.com-এ আমাদের সাথে যোগাযোগ করুন, যাতে আমরা অনানুষ্ঠানিকভাবে সমাধানের চেষ্টা করতে পারি।

এই শর্তাবলি, Orbitacare বা আমাদের সেবা থেকে উদ্ভূত বা সংশ্লিষ্ট যেকোনো বিরোধ বাংলাদেশের উপযোগী আদালতের এখতিয়ারাধীন হবে, যদি প্রযোজ্য আইন অন্য কিছু না বলে।

২৮. এই শর্তাবলির পরিবর্তন

আমরা সময়ে সময়ে এই শর্তাবলি আপডেট করতে পারি। গুরুত্বপূর্ণ পরিবর্তন হলে আমরা ওয়েবসাইট, অ্যাপ, ইমেইল, SMS, পুশ নোটিফিকেশন বা অন্য উপযুক্ত মাধ্যমে জানাতে পারি। আপডেট করা শর্তাবলি পোস্ট বা জানানো হলে কার্যকর হবে।

আপডেট করা শর্তাবলি কার্যকর হওয়ার পর Orbitacare ব্যবহার চালিয়ে গেলে আপনি আপডেট করা শর্তাবলিতে সম্মত বলে গণ্য হবেন।
